1. Your agreement with BWD.io
Huck is operated by Better Web Design and Development Services, LLC, doing business as BWD.io (BWD, we, us or our). These terms govern our website, workspace console, APIs, embedded assistants and related services. You means the person or organization accepting these terms. A person accepting for an organization represents that they have authority to bind it. Workspace account holders must be at least 18 and able to enter a binding agreement.
Our Acceptable Use Policy, AI & Human Oversight Notice, Billing & Refund Policy and, where applicable, Data Processing Addendum form part of this agreement. The Privacy Notice explains our information practices. A separately signed agreement controls an express conflict for that customer. Accepting these terms does not itself purchase a subscription; a separate checkout confirms its price and recurring charge.
2. What the service provides
Huck helps you index information, retrieve context subject to your configured access rules, generate AI responses, evaluate behavior and connect customer-hosted actions. Your subscription provides access within the published plan limits; it does not transfer ownership of the platform. Features, models and third-party availability may change. We will give reasonable advance notice of a material reduction to a paid service, except where urgent security, legal or provider circumstances prevent it.
The service is not an archive, an emergency service, a professional adviser or a substitute for your own systems of record. Keep independent copies of information you need. There is no uptime, support-response or accuracy guarantee unless a separate written agreement expressly supplies one.
3. AI, retrieval and evaluations
AI may produce inaccurate, incomplete, biased, outdated or fabricated statements, citations or action arguments. Retrieval and access checks reduce particular risks; they do not prove that source material or an answer is true. Passing evaluations establishes results for the cases, data, identity and settings tested. It is not certification, a guarantee of future behavior or a promise of regulatory compliance.
Review consequential outputs against authoritative records before relying on them or exposing them to others. You remain responsible for decisions, claims and transactions you authorize. Do not use Huck as the sole basis for medical, legal, financial, employment, credit, housing, insurance or other decisions affecting a person’s rights or safety. Use an appropriate qualified reviewer and any legally required safeguards. Our AI & Human Oversight Notice explains these responsibilities in more detail.
4. Your information, identities and integrations
You retain your rights in the information you submit. You grant BWD the limited rights needed to host, copy, transform, index, retrieve, transmit and process it to deliver, secure, support and troubleshoot your service under this agreement. We do not acquire ownership of your knowledge base or permission to sell it. Feedback about the product may be used to improve Huck, but that permission does not turn private customer content into unrestricted feedback.
You must have the necessary rights, notices, permissions and lawful basis for your data and for its processing by the listed service providers. Keep it accurate and current. Configure gates, organizations, users, origins and permissions correctly; protect server keys; revoke access promptly; and test authorization and isolation before deployment. Never put server credentials in a public page. A relationship reference or a prompt instruction is not an access grant.
Your connected systems control their own authorization and side effects. Review action permissions, use confirmations where appropriate and implement idempotency, status reporting and recovery. A timeout or cancellation in Huck cannot guarantee that an external action did not already execute. You are responsible for your own websites, customer representations and integrations; this does not excuse BWD from responsibility that law assigns to BWD for its own conduct.
5. Accounts and permitted use
Provide accurate account and billing information, keep access credentials confidential and tell us promptly about suspected compromise. Only authorized people may use your workspace. You are responsible for activity you authorize and for reasonable protection of your credentials, but not for a security failure attributable to BWD merely because it affected your account.
You may use the service for lawful business purposes within your plan. You may not resell access to the platform itself, bypass technical limits, misrepresent affiliation, infringe others’ rights or use the service contrary to the Acceptable Use Policy. You may embed and customize assistants for your own services as your plan permits. Removing Huck branding does not remove your duty to identify automated interactions where required.
6. Subscriptions, limits and cancellation
Paid plans renew monthly until canceled. Checkout shows the recurring amount, currency and applicable taxes before you authorize payment. Plan allowances and technical limits are described on the pricing and usage screens. The free Sandbox is not an automatically converting paid trial. We do not charge automatic usage overages under the standard monthly plans; reaching a limit can stop new billable work.
Use the billing portal linked from your workspace to cancel renewal or manage payment information. Normal cancellation takes effect at the end of the paid period. If the portal is unavailable, contact support promptly with your workspace and cancellation request; do not send card details. Deleting an embed or stopping use does not cancel a subscription. The Billing & Refund Policy governs refunds, changes, nonpayment and spending holds, subject always to mandatory rights.
Future price changes will be disclosed before the renewal to which they apply, with an opportunity to cancel. We will not retroactively change the price for an already paid period. Taxes and legally required charges are disclosed where applicable. Any approved bespoke arrangement must be confirmed separately in writing.
7. Confidentiality and data protection
Each party must use the other’s nonpublic business information only to perform this agreement or exercise its rights under it, protect it with reasonable care, and restrict access to people and providers who need it and are subject to appropriate confidentiality obligations. This does not cover information already lawfully known, independently developed, lawfully received without restriction or public without breach.
A legally required disclosure is permitted; where lawful and practicable, the receiving party will notify the other and seek to limit disclosure. Personal-data handling is also subject to applicable law, the Privacy Notice and the Data Processing Addendum where relevant. A liability clause does not waive a person’s nonwaivable privacy rights.
8. Suspension and ending service
We may restrict access reasonably necessary to address unpaid fees, a material breach, credible abuse, security threats, legal requirements or a financial/spending hold. Where practicable, we will explain the reason and give an opportunity to resolve it. Suspension is not an additional charge and does not itself confirm that a refund or cancellation succeeded. You can contact support to challenge an error or request data recovery.
Either party may end the agreement for a material breach not cured within 30 days after written notice, or sooner for a breach that cannot reasonably be cured or where continued service would be unlawful or materially unsafe. If we discontinue your paid service for our convenience, we will refund prepaid fees for the unused portion. Required statutory remedies remain available. On termination, access ends; return or deletion of customer personal data is addressed in the Data Processing Addendum and Privacy Notice. Obligations intended to survive, including accrued fees, confidentiality, lawful retention and liability limits, survive.
9. Warranties and limitations of the service
We will provide the service with reasonable care and skill. Except for that commitment, an express written agreement and warranties that cannot legally be excluded, the service and AI outputs are provided as available, without implied warranties of merchantability, fitness for a particular purpose or noninfringement. We do not promise uninterrupted operation, perfect security, unique outputs or error-free information.
A disclaimer cannot remove a mandatory warranty or remedy. If an applicable law gives you protections that cannot be waived, those protections take priority over inconsistent language here.
10. Limits on liability
To the extent permitted by applicable law, BWD and its suppliers will not be liable under this agreement for indirect, incidental, special, consequential or punitive damages, or loss of anticipated profits, business opportunities or goodwill. This applies regardless of the legal theory and whether the possibility was discussed, but only to the extent the exclusion is lawful.
To the extent permitted by applicable law, BWD’s aggregate liability arising from this agreement and the affected service will not exceed the greater of US $100 or the fees you actually paid BWD for that affected service in the 12 months before the event giving rise to the claim. Related events count as one event for this purpose. This limit does not reduce a refund expressly owed under this agreement.
These exclusions and caps do not apply to fraud, willful misconduct, gross negligence, death or personal injury caused by negligence where exclusion is prohibited, or any other liability that cannot legally be excluded or limited. They do not limit statutory rights of data subjects. The parties intend the lawful portions to allocate commercial risk, not to eliminate protections the law makes mandatory.
11. Third-party claims caused by customer conduct
To the extent permitted by law, a business customer will defend BWD against a third-party claim resulting from that customer’s unlawful content, infringement by material it supplies, or material violation of the Acceptable Use Policy, and pay resulting amounts finally awarded or approved in settlement. This obligation does not apply to the extent a claim is caused by BWD’s breach, negligence or unlawful conduct.
BWD must promptly notify the customer, provide reasonable cooperation at the customer’s expense and allow control of a competent defense. No settlement may admit fault for BWD, impose nonmonetary obligations on it or fail to release it without its consent, which will not be unreasonably withheld. This provision does not require indemnification where applicable consumer law prohibits it.
12. Disputes and general terms
Contact us first so we can try to resolve a concern. Except where mandatory law requires otherwise, Arizona law governs this agreement without its conflict-of-law rules, and courts with jurisdiction in Arizona may hear disputes. This provision does not deprive consumers of mandatory home-jurisdiction protections or access to a competent regulator. These terms do not impose mandatory arbitration or a class-action waiver.
Neither party is responsible for delay caused by events beyond its reasonable control, except obligations already due and duties that law does not excuse. Each party must take reasonable steps to reduce the impact. You may not assign the agreement without consent except as part of a genuine transfer of substantially all related business assets; BWD may transfer it to a successor subject to the existing protections. No waiver is effective merely because a right was not immediately enforced. An unenforceable provision will be limited or severed without invalidating the rest.
We publish dated versions and retain the version recorded when you accept. Material changes will be notified through the account or email before taking effect; changes do not retroactively remove accrued rights. Changes requiring new assent will be presented for acceptance. Urgent legal or security changes may take effect sooner with notice as practicable. Written notices may be sent to the contact and mailing address shown on this page.
